MTX Realty, LLC (“MTX Realty,” “MTX,” “we,” “our,” or “us”) respects the privacy of visitors to our websites and of clients, customers, prospective clients, consumers, and others whose personal information we receive in connection with our real estate brokerage activities.

This Privacy Policy explains the types of information we may collect, how we may use and share that information, how we seek to protect it, and choices or rights that may be available under applicable law.

This Policy applies to MTX Realty websites, online forms and services, and personal information collected in connection with MTX Realty brokerage activities. It does not replace contractual obligations, legally required disclosures, or the privacy policies of independent third-party services.

Information We May Collect

The information MTX Realty collects depends on how a person interacts with us and the services involved.

We may collect:

Not every category of information is collected from every person or in every transaction.

How We Collect Information

MTX Realty may collect information directly from you when you contact us, submit an online form, register for an account, request property information, enter into a brokerage relationship, communicate with an MTX Realty Sales Associate, sign transaction documents, participate in a real estate transaction, or otherwise provide information to us.

We may also receive information through authorized technology systems and from third parties participating in or supporting a transaction, including MLS providers, title companies, lenders, inspectors, attorneys, cooperating real estate professionals, electronic-signature platforms, transaction-management providers, payment processors, and other service providers.

How We Use Information

MTX Realty may use personal information to:

  • Provide real estate brokerage services.
  • Respond to inquiries.
  • Communicate about properties and transactions.
  • Prepare, administer, negotiate, and close real estate transactions.
  • Maintain required brokerage and transaction records.

Real Estate Transaction Information

Real estate transactions often require information to be shared among multiple participants.

When reasonably necessary to provide requested brokerage services or complete a transaction, MTX Realty may disclose appropriate information to persons such as title companies, lenders, inspectors, appraisers, attorneys, cooperating brokers and agents, MLS organizations, transaction coordinators, accountants, insurers, and other service providers or transaction participants.

MTX Realty and its Sales Associates are expected to exercise reasonable discretion and disclose only information appropriate for the applicable transaction or business purpose.

Sensitive Personal Information

MTX Realty seeks to minimize unnecessary collection and storage of highly sensitive information.

Sensitive information may include Social Security numbers, taxpayer-identification numbers, government-issued identification information, financial-account information, banking information, payment-card information, access credentials, and other information protected by applicable law.

Where reasonably available, sensitive payment and banking information should be submitted directly through an MTX-authorized secure payment or banking system rather than ordinary email, text message, or unsecured documents.

Taxpayer-identification information should ordinarily be provided through appropriate tax documentation, such as Form W-9, when required.

MTX Realty uses and discloses sensitive personal information only for legitimate brokerage, transaction, legal, accounting, security, or business purposes and as otherwise permitted by applicable law.

Website Logs, Cookies and Analytics

MTX Realty websites and technology providers may automatically collect technical information when a person visits or uses the website.

IDX information is provided for consumers' personal, non-commercial use and remains subject to applicable MLS rules and required IDX disclosures.

MTX Realty uses third-party technology and professional service providers to conduct brokerage operations.

  • CRM and lead-management systems.
  • Transaction-management systems.
  • Electronic-signature services.
  • Document storage.

  • Accounting and payment processing.
  • Cybersecurity.

These providers may process personal information on MTX Realty's behalf or as necessary to provide their services.

Third-party websites and services may maintain their own privacy policies. MTX Realty is not responsible for the independent privacy practices of websites or services it does not control.

Information Security

MTX Realty uses reasonable administrative, technical, and operational safeguards intended to protect personal information from unauthorized access, disclosure, alteration, misuse, or loss.

Access to Information

Those persons may include the Sales Associate servicing a transaction, the Designated Broker, authorized brokerage or administrative personnel, and authorized professional or technology service providers.

MTX Realty Sales Associates are required to comply with MTX Realty policies concerning confidentiality, privacy, recordkeeping, and data security.

Retention of Information

MTX Realty may retain brokerage, transaction, accounting, tax, compliance, communication, and other records for the period required by applicable law, TREC rules, contracts, insurance requirements, legitimate business needs, or MTX Realty policy.

Records may be retained longer when reasonably necessary because of litigation, claims, investigations, tax obligations, regulatory matters, or other legitimate business or legal reasons.

Disposal of Personal Information

When personal information is no longer required to be retained, MTX Realty uses reasonable measures intended to prevent unauthorized access during disposal.

Depending on the type of record, this may include shredding paper documents or securely erasing, destroying, or otherwise rendering electronic information unreadable or indecipherable.

Security Incidents and Data Breaches

Known or suspected unauthorized access, disclosure, loss, theft, compromise, or misuse of MTX Realty or consumer information should be reported promptly to MTX Realty.

MTX Realty will evaluate reported incidents and take reasonable action appropriate to the circumstances and applicable legal requirements.

Children's Privacy

MTX Realty's websites and brokerage services are not directed to children under 13.

MTX Realty does not knowingly seek to collect personal information directly from children under 13 through its general website services.

If we learn that personal information from a child was collected in circumstances requiring deletion or parental consent, MTX Realty will take appropriate action consistent with applicable law.

Sale of Personal Information and Targeted Advertising

MTX Realty does not operate as a data broker.

MTX Realty may use technology providers for website analytics, advertising, CRM, or marketing functions. Certain privacy laws may define some transfers or advertising activities differently from ordinary real estate transactions.

If MTX Realty engages in processing that constitutes a “sale” of personal data, targeted advertising, or another activity requiring notice, consent, or an opt-out under applicable law, MTX Realty will provide the required notice or consumer choice.

Residents of Other States

Residents of states other than Texas may have additional privacy rights under laws applicable to them.

MTX Realty will address legally applicable requests in accordance with the law governing the particular request.

This Policy does not state that MTX Realty is subject to every state privacy statute merely because a person from that state accesses the website.

Changes to This Policy

MTX Realty may update this Privacy Policy as laws, technology, website features, business practices, or brokerage operations change.

The current version will be posted on the MTX Realty website with an updated effective or revision date.
